ISLAMABAD— The Supreme Court Friday issued notices to Inter Services
Intelligence (ISI), Military Intelligence (MI) and Ministry of Defence
to submit answer within two weeks pertaining to Adiala jail missing
prisoner’s case.
A three-member Supreme Court (SC) bench headed by Chief Justice of Pakistan Iftikhar Muhammad Chaudhry heard the proceedings of missing persons of Adiala Jail case.
Tariq Asad who is the counsel of missing prisoners in the case told SC that the ISI and MI are prosecuting the missing prisoners of Adiala jail according to the Military Act which is against the laws.
Advocate Tariq Asad, the counsel of missing prisoners Abdul Majid and Abdul Basit told the court that they had filed an application before the internment authority but it was rejected.
Justice Jawad S Khawaja remarked that prisoners were treated in good manners during period of the Holy Prophet Muhammad (Peace Be Upon Him) and interment authority should treat prisoners according to laws adding that court will not tolerate any inhuman and illegal action against the prisoners.
Chief Justice Iftikhar Muhammad Chaudhry remarked that earlier these prisoners were treated inhumanly and court can not close its eyes adding that if these prisoners are terrorists then hang them otherwise release them if they are not guilty.
Advocate General Khyber Pakhtunkhwa told SC that better medical facilities are being provided to the prisoners after directions of the SC and their health is also improving.
Advocate Tariq Asad requested the SC to stop spy agencies for prosecuting missing persons according to the Army Act and order to release them.
The SC issued notices to ISI, MI and Ministry of Defence to submit reply regarding the case and adjourned the hearing for two weeks.
The eleven civilians were picked up from Adiala Jail by intelligence agencies after they had been acquitted by a court.
